By using Pondofy (“the Service”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please discontinue use of the Service. We may update these terms periodically; continued use constitutes acceptance of the revised terms.

1. Entire Agreement

These Terms of Use constitute the entire agreement between you and Pondofy regarding your use of the website and its services and supersede all prior agreements.

2. Permitted and Prohibited Uses

You may use Pondofy only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal activity or in violation of any applicable law
• Download, reproduce, or distribute copyrighted content without proper authorisation
• Use the Service to circumvent digital rights management (DRM) or technological protection measures on streaming platforms such as YouTube, Spotify, or Apple Music in ways not permitted by those platforms' own terms
• Attempt to reverse-engineer, scrape, or overload our infrastructure
• Use automated tools to make bulk requests to our API without prior written permission

3. Copyright and Intellectual Property

Downloading content for personal, non-commercial use is generally permitted in many jurisdictions. However, it is your responsibility to understand and comply with the copyright laws that apply in your country. Pondofy does not make any determination as to whether a specific download is lawful for you — that determination rests entirely with you as the user.

You are responsible for ensuring you own or have the necessary rights, licences, or permissions for the content you download using Pondofy. Distributing, selling, publicly performing, or otherwise using copyrighted content without the permission of the rights holder may constitute copyright infringement and can lead to serious legal consequences, including civil liability and criminal prosecution depending on your jurisdiction.

As a general guide — though not legal advice:

• Generally permitted: downloading a song or video you have already paid for, for personal offline playback on your own devices.
• Generally not permitted: downloading content you have not paid for, sharing downloaded files with others, using downloaded content in your own videos, streams, or commercial projects without a licence.
• Always check: some streaming platforms explicitly prohibit downloading even for personal use in their own Terms of Service, regardless of copyright law in your country.

We strongly encourage you to respect the work of artists, musicians, and content creators. If you enjoy someone's content, consider supporting them through official channels such as streaming subscriptions, purchases, or merchandise.

4. DMCA Compliance

Pondofy respects intellectual property rights. If you believe content accessible through our Service infringes your copyright, please send a DMCA notice to [email protected] including:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to be infringed
• The URL or description of the allegedly infringing material
• Your contact information (name, address, telephone, email)
• A good-faith statement that the use is not authorised
• A declaration, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner

Accounts or IP addresses determined to be repeat infringers will be permanently blocked.

5. File Storage, Expiry, and Deletion

Files you convert remain your property. We access and temporarily store them solely to provide the Service. All converted files are automatically and permanently deleted from our servers 1 hour after conversion. This deletion is enforced at the server level and cannot be extended or reversed.

To help you act within this window, the Service displays a live countdown timer immediately after a file is ready. When the timer expires, the download link is deactivated and the file is removed. You are solely responsible for downloading your file before the expiry time. Pondofy accepts no liability for files that were not downloaded within the 1-hour window.

The 1-hour retention limit also serves an important copyright-protection function: it minimises the duration for which any converted file exists on our infrastructure, reducing the risk of unauthorised redistribution and helping us comply with the spirit of applicable copyright law. Deliberately attempting to re-download or cache a file beyond its expiry window using automated means is a violation of these Terms.

6. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that conversion results will meet your requirements. Your use of the Service is entirely at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, Pondofy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service.

8. External Links

Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of those sites. Following external links is at your own discretion and risk.

9. Termination of Access

We reserve the right to restrict or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved in the courts of competent jurisdiction where the service operator is located.
